Expungement in Northern Kentucky
Clearing a Kentucky record in Kenton, Boone, and Campbell County works the same way as everywhere else in the state. Here is what is specific to Northern Kentucky, and how to find out in two minutes whether you qualify.
Where your case gets filed
Expungements are filed in the court that decided the original case: the Circuit and District Courts in Covington (Kenton), Burlington (Boone), and Newport (Campbell). The petition goes to the Commonwealth’s Attorney for the 16th or 17th Judicial Circuit, or the respective County Attorney, who has sixty days to respond. If they do not object, the court can grant it without a hearing, and most clients never appear.
Many Northern Kentucky clients have records on both sides of the river. Ohio convictions cannot be expunged under Kentucky law, but we can tell you which of your cases are Kentucky cases and coordinate with Ohio counsel on the rest.
Who we help here
People from Covington, Florence, Newport, Fort Mitchell, Erlanger, Independence, and the rest of Kenton, Boone, and Campbell counties. Everything can be handled by phone, email, and e-filing from wherever you live now; you do not have to come to us, and for most cases nobody has to go to court.
What qualifies
- Class D felonies, five years after the sentence, with no new convictions since. Multiple felonies allowed since 2023.
- Misdemeanors, five years after the sentence, no limit on how many. DUI waits ten years from the offense.
- Dismissed, acquitted, and never-indicted charges, often free and sometimes automatic.
What it costs
Court fees are set by statute: $40 for the certification, $100 per misdemeanor case, $50 plus $250 per felony case, and nothing for dismissed charges. Our flat fees start at $500 for a misdemeanor and $1,000 for a felony, and the $50 attorney record review is credited toward them.
