Expunging a misdemeanor in Kentucky
Misdemeanors are the easiest records to clear in Kentucky, and there is no limit on how many you can expunge.
Who qualifies
KRS 431.078 covers misdemeanors, violations, and traffic infractions, with four exceptions:
- Sex offenses and offenses committed against a child cannot be expunged.
- You cannot have a felony or misdemeanor conviction in the five years before you file.
- Nothing can be pending against you.
- An offense that could still be used to enhance a later charge has to wait until that enhancement window closes. DUI is the big one: see the DUI page. Driving on a suspended license and some domestic assault charges can work the same way.
The waiting period
Five years after you finish the sentence, including any probation or conditional discharge. The same five years must be clean of any new conviction.
What it costs
$100 per case, and $50 of that comes back if the petition is denied. The fee is due in each county where you file, but a single $40 certification covers all your cases everywhere. Our flat fee starts at $500.
How the process goes
The petition is filed in the District Court where you were convicted. The prosecutor gets notice and the court can set a hearing, though for most misdemeanors it is decided on the papers. Once granted, the conviction is vacated and the record is deleted from court and police systems; the court will say no record exists, and you do not have to disclose it on applications.
Charges amended down
If you were charged with something more serious and it was amended to a misdemeanor you then pleaded to, the statute lets the original, higher charge be expunged along with the conviction. Those "dismissed or amended" charges in the same case ride along.
